PROGRAM OUTLINE:
In this session, the panelists will discuss the ACA repeal and replace legislation currently being debated on Capitol Hill.  They will review the competing visions from various Republican members of the House and Senate, as well as the path proposed by President Trump.  The panel will highlight the concepts that appear frequently throughout the proposals and, at this point, seem most likely to be adopted in the eventual replacement bill.

This session will also cover some of the industry shifts that may result from the post-ACA landscape.  For example:

  • What market reform provisions are likely to survive? 
  • If the market reform provisions are not required would employers continue to cover dependents to age 26? 
  • How do the Republican proposals address the pre-existing condition issue?
  • Will employers move back to requiring 40 hours per week for plan eligibility?
  • Will the Cadillac tax be replaced with a cap on the exclusion from income?
  • How will HSAs play an expanded role?
  • How could the sale of insurance across state lines affect group health plans?
  • Will the individual market compete with employer-sponsored plans?

Lastly, President Trump campaigned on a number of dependent care tax reforms, including new above-the-line deductions, dependent care savings accounts, employer on-site daycare incentives, and federal paid maternity leave.  The panelists will review these proposals and the prospect of their inclusion in an ACA replace bill or broader tax reform bill.          

PANEL OF SPEAKERS:  
Brian Gilmore, Lead Benefits Counsel, Vice President
ABD Insurance and Financial Services

Brian Gilmore is the Lead Benefits Counsel at ABD Insurance and Financial Services.  He assists clients on a wide variety of employee benefits issues, particularly with respect to ACA compliance requirements and strategies.  Prior to joining ABD, Brian was an attorney at Trucker Huss.  He also has experience at the DOL's Employee Benefits Security Administration as a Benefits Advisor.

Brian received his undergraduate degree from the University of California, Berkeley, and his law degree from the University of San Francisco School of Law.

Julie Burbank, Senior Counsel
Chevron Corporation 
                   

Julie Burbank is Senior Counsel in Chevron Corporation’s Employment & Corporate Services Law Group where she is responsible for ERISA compliance with respect to Chevron’s numerous health and welfare benefit programs.  From 2008-2010, Julie analyzed numerous proposals that were to form the basis of health care reform. Since its passage in 2010, Julie has been actively involved in analyzing and implementing the provisions of the Patient Protection and Affordable Care Act that impact large employers.  Prior to rejoining Chevron in mid-2013, Julie was a Director at a San Francisco employee benefits law firm.

Julie was named by Corporate Counsel Magazine as one of "The Best Lawyers in America" in employee benefits law in 2008, 2009, 2010, 2011, 2012, 2013 and 2014.  Julie has made numerous presentations on a variety of employee benefit plan topics for ALI-ABA, the American Bar Association, the American Society of Pension Professionals and Actuaries, the International Foundation of Employee Benefit Plans, the International Society of Certified Employee Benefits Specialists, the Silicon Valley Employers Forum and the Western Pension and Benefits Council.

Julie also serves on the Board of Directors of the ERISA Industry Committee, the only national association that advocates exclusively for large employers on health, retirement, and compensation public policies at the federal, state, and local levels.
